outland.work specializes in sourcing and matching highly skilled freelancers from Latin America (our "Freelancers") with businesses based in the United States (our "Clients"). We also operate tools and processes that support Freelancers and Clients throughout engagements, such as assessment procedures, background checks, and time-tracking or workflow systems (if applicable). We take your privacy seriously and want you to know that we are not in the business of selling your information.

This Privacy Policy ("Privacy Policy") explains our data practices, describing in detail how and why we collect, use, and share information about our users in compliance with relevant data regulations.

Scope

This Privacy Policy covers how we collect, retain, and use information, including personal data ("Personal Data") about:

  • Freelancers (including prospective Freelancers applying to be part of our network);
  • Clients and prospective Clients;
  • Job applicants (for roles within outland.work);
  • Visitors to our Sites;
  • Vendors and service providers who help us deliver our Services;

We process Personal Data in accordance with applicable data protection laws and regulations.

Collection and Use of Personal Data

The Personal Data we collect and how we use it depends on your relationship with outland.work.

A. Freelancers

We recruit, screen, and match Freelancers from Latin America to serve Clients in the United States.

i) Information We Collect

Information You Provide

During the screening process, or when you join our freelance network, we may ask you to provide:

  • Name
  • Contact information (email, phone number, address)
  • Location
  • Work experience
  • Education history
  • References
  • Photo (optional, but may be requested to verify identity or for your profile)
  • Government-issued identification
  • Social network information (LinkedIn, GitHub, etc. if applicable)
  • Billing and/or payment details

We may record audio or video calls during your application process and ongoing engagements (with your permission), for training, quality assurance, and to document skill assessments. This helps ensure we accurately represent your capabilities to Clients.

Identity Verification / Biometric Data

In some cases, we may require you to verify your identity by uploading a photo of yourself and/or your government-issued ID. We partner with third-party identity verification providers ("Verification Providers") who may use facial recognition technology and other means to:

  • Confirm the authenticity of your government-issued identification;
  • Compare your photo to the ID on file (biometric information).

These Verification Providers collect and process such biometric data solely for identity verification and fraud prevention. Biometric data is typically deleted once the verification process is complete, or after a legally mandated retention period (if applicable). outland.work does not receive or store the raw biometric data itself.

Background Checks

Depending on the role or Client engagement, we may request a background check through a third-party provider. We will obtain your explicit consent where required by applicable law.

Profile Creation

Once you join our network, we use your Personal Data to create a professional profile and skill set summary, which we may share with prospective Clients seeking talent. We may also feature you in marketing materials or presentations to demonstrate the expertise in our network.

Feedback from Clients

When you work with a Client through us, they may provide feedback or performance reviews about you. We may store and use such information to improve our Services, maintain network standards, and match you with future opportunities.

ii) How We Use Freelancer Information

To Provide Our Services and Respond to Requests

We use Freelancer information to:

  • Evaluate applications and qualifications;
  • Administer agreements and contracts;
  • Match Freelancers with suitable Client engagements;
  • Provide support and answer questions.
For Legitimate Interests

We may also process Freelancer data:

  • To maintain high standards of integrity and professionalism in our network;
  • To conduct analytics (e.g., how Freelancers use our Site and Services);
  • To improve or market our offerings;
  • To prevent fraud or misuse of our systems;
  • To comply with legal obligations.
Additional Uses

We may use your Personal Data for certain additional purposes consistent with this Privacy Policy or as permitted by applicable law. For example, we might share call recordings or video interviews with prospective Clients to demonstrate your skills if it aligns with the purposes for which your data was collected. B. Clients and Prospective Clients

ii) How We Use Client Information

To Provide Services and Respond to Requests

We use Client data to:

  • Provide our Services and maintain accounts;
  • Facilitate Client-Freelancer engagements;
  • Communicate important updates or changes to our terms and policies;
  • Process invoices and payments.
For Marketing and Business Interests

Where permitted by law, we may use your contact details to:

  • Send updates about new Freelancers, relevant business resources, or upcoming events;
  • Inform you of promotions or special offers;

You can opt out of marketing communications at any time. However, administrative emails related to billing, service notifications, or other operational matters are not considered marketing communications.

Credit Checks

i) Information We Collect

If you apply for a position with outland.work (not as a Freelancer, but as an employee or contractor in our corporate team), you may provide:

  • Resume/CV, cover letters, references;
  • Employment history, education, and qualifications;
  • Salary expectations and/or history.

During the recruitment process, we may:

  • Conduct assessments or interviews (audio, video, or in-person) and create notes regarding your suitability for roles;

ii) How We Use Job Applicant Information

Since outland.work does not currently offer comments sections or user forums, Personal Data you post publicly on other websites or social media platforms is governed by those platforms' policies, not this one. We are not responsible for the practices of external websites and encourage you to review their privacy statements.

Children

outland.work does not knowingly collect Personal Data from individuals under 16 years of age. If you are under 16, please do not use our Sites or provide any Personal Data. If we learn that we have collected Personal Data from someone under 16, we will delete it.
